JUDGMENT: (per Manoj Kumar Gupta, C.J.)

The present petition filed ostensibly in public interest seeks a mandamus to the respondent- authorities to conduct a fair, impartial and independent inquiry in the alleged misuse of public funds in Village Khati, Post Gangro, Tehsil Kalsi, District Dehradun, Uttarakhand by the Village Pradhan (respondent no. 5 herein).
2. Under Section 95 (1) (g) of U.P. Panchayat Raj Act, 1947, a complete procedure is prescribed for holding inquiry in such matters. Under the Act, Rules 1
2026:UHC:2510-DB have also been framed laying down the procedure for holding such inquiry.

In view of availability of the said efficacious remedy, we decline to examine the issues raised through the PIL. It is left open to the petitioner to avail the said remedy, if so advised.
