Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 73.240 kgs. of Ganja and petitioner is in custody since June, 2025 i.e. for about 13 months. It has been submitted that charges have already been framed, but till date, no witness has been examined. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that seizure was from the possession of the petitioner and another. Having considered the contraband seized in the present case, I am of the view that the petitioner has failed to overcome the rigours of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected at this stage. 2 Learned Trial Court would give priority to examine independent seizure list witnesses preferably within a period of three months from the date of communication of this order. Petitioner will renew his prayer for bail after the evidence of seizure list witnesses is over. The application for bail, being CRM (NDPS) 1368 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
