Mr. Krishnendu Bhattacharya Mr. Sankalpa Bhattacharya. …for the State. The subject matter of the case relates to alleged recovery of 1625 ampoules of buprenorphine. Records of the case reflect that the seizure was effected from the co-accused and the present petitioner has been implicated on the basis of statement of co-accused. A query was placed by the co-ordinate Bench regarding the antecedent of the petitioner as also whether any CDR or money trail is involved in the present case. A report has been submitted which reflects that there are no CDR nexus or any antecedent of the present petitioner. As the charge- sheet has been submitted before the jurisdictional court, I am of the opinion that custodial interrogation of the petitioner is not warranted. As such, the prayer for anticipator bail of the petitioner 2 is allowed. Accordingly, in the event of arrest, the petitioner, namely, Niranjan Pahan shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge-sheet has already been submitted before the jurisdictional court, the order of anticipatory bail will remain in force for a period of six weeks. Accordingly, CRM(A)837 of 2026 is allowed. Report submitted by the State be kept with the record. The investigating officer of the case is present before this Court pursuant to the earlier direction. His further appearance before this Court is dispensed with. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
