Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 1 year 8 months and has been implicated in number of cases. Learned advocate for the State opposes the prayer for bail and submits that the petitioner was arrested pursuant to the order of proclamation having been issued. There was a transaction of Rs.2.7 lakhs with the other accused although whole of the case involves amounting to Rs.27 lakhs. The other accused is in custody who happens to be the husband of the lady. Two charge-sheets have been submitted in connection with the instant case and investigation of the case is still in progress. Having considered the period of detention of the present petitioner and till date prosecution submits that they would rely 2 upon 35 witnesses although the investigation is still in process, I am of the view that the case being based on documents, the petitioner being a lady who is in custody for about 1 year 8 months, her further detention may not be warranted in the facts of the present case. As such, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Sraboni @ Shrabani Chatterjee shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Malda. If on bail, the petitioner shall make herself available as and when called for by the investigating officer of the case and shall not leave the district of Malda without prior permission of the learned jurisdictional court. Additionally, the petitioner shall inform her present address to the investigating officer of the case where she would be residing and would hand over her mobile number so that she is available when the investigating officer of the case requires. With the aforesaid observations, CRM(M)1370 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
