Kausik (Rejected) CRM (NDPS) 1459 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Katwa Police Station Case No. 167 of 2025 dated 05.03.2025 under Sections 15(c)/18(b) of the NDPS Act, 1985. And In the matter of : Ansar Sk & Anr. ……Petitioners. Mr. Dattatreya Dutta Mr. Monjit Bhattacharjee ……for the Petitioners. Mr. Sagar Saha Ms. Nayana Mukhopadhyay ……for the State. Learned advocate appearing for the petitioners submits that petitioner no. 1 is disabled and petitioner no. 2 is his son. Both were implicated on alleged recovery of 489 Kgs. of Ganja. Both the petitioners are in custody since March, 2025. Till date only charges have been framed and the witness action has not commenced. Learned advocate for the State opposes the prayer for bail. In view of the huge quantum of recovery in the present case, I have taken into account the quantum of recovery. Since rigors of Section 37 of the NDPS Act is attracted, I am not inclined to release the petitioner on bail. 2 Accordingly, prayer for bail of the petitioners in CRM (NDPS) 1459 of 2026 is rejected. Learned Trial Court would expedite the examination of the witnesses. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
