Learned advocate appearing for the petitioner submits that the alleged recovery in the present case 606 grams of heroin and the petitioner is in custody for about one year one month. Although, charge sheet has been submitted but charges have not been framed. As such, the petitioner prays for bail. Learned advocate for the State opposes the prayer for bail. Attention of the Court was drawn to the chemical examiner’s report by the petitioner which reflects there is some Diacetylmorphine (Heroin), 6-Monaacetyimorphine and Acetyicodeine. Having considered the case being covered by the judgment of the Hon’ble Supreme Court in Sentu Seikh versus State of West Bengal (SLP (Crl.) No. 13987 of

2025, I am of view that the petitioner is entitled to be released on bail. Thus, prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned Judge, NDPS Act, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District Malda without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1484 of 2026 is allowed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
