Cr.M.P. No.454 of 2026 in Cr.Appeal No.4102 of 2013 04.02.2026 Present: Mr. Sidharth Jalta, Deputy Advocate General, for the non-applicant/State. Mr. Karan Veer Singh, Advocate, for the applicant/respondent. By way of the present application, the applicant/respondent has prayed for extension of time for furnishing the bail bonds in terms of the judgment passed by this Hon’ble Court on 16.09.2025.
2. As per the facts mentioned in the application, the applicant/respondent is serving in the Army and was posted in a forward area, and due to this reason, could not secure leave for furnishing the bail bonds before the learned trial Court. The applicant/respondent had earlier 3led an application before the learned Additional Chief Judicial Magistrate, Court No.II, Dehra, District Kangra, H.P. for attestation of personal and surety bonds for complying with the provision of Section 437A of Cr.P.C/481 of BNSS. However, the said application was rejected by the Additional Chief Judicial Magistrate, Court No.II, Dehra, District Kangra, H.P.
3. The applicant/respondent after rejection of his application had joined his service at Uri, Jammu & Kashmir.
4. Since the applicant/respondent is serving in the Army, the application deserves to be allowed.
5. Keeping in view the peculiar facts of the present case coupled with the fact that the applicant/respondent is serving in the Army, the application is allowed and the applicant/respondent is directed to furnish bail bonds in terms of the judgment dated 16.09.2025 passed by this Court in Criminal Appeal No.4102 of 2013, titled, State of Himachal Pradesh vs. Ravinder Kumar within a period of two weeks.
6. The application is accordingly disposed of.
