Accused No. 2 in Crime No. 315/2025 registered by Suddaguntepalya Police Station, Bengaluru for offences punishable under Sections 107 and 108 read with Section 3(5) of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the petitioner and learned HCGP for the respondent. - 3 - HC-KAR CNR: KAHC010453002026 NC: 2026:KHC:36803 CRL.P No. 9712 of 2026 3. FIR in Crime No. 315/2025 was registered by Suddaguntepalya Police Station, Bengaluru for the aforesaid offences against one Viji and others, based on the first information dated 08.12.2025 received from Smt. Maheshwari. Apprehending arrest in the case, petitioner had filed criminal case in Crl.Misc.No. 6115/2026 before the jurisdictional Sessions Court at Bengaluru, which was rejected on 30.06.2026. Therefore, he is before this court. 4. A perusal of the first information would go to show that in the alleged incident that had taken place on 08.12.2025, three persons by name Sudha, Monish Kumar and Madamma had committed suicide. Monish Kumar was the son and Madamma was the mother of deceased Sudha. In the first information it is alleged that, deceased Sudha had left behind a death note mentioning the name of the accused persons named in the FIR as the cause for her death and with regard to certain monitory transactions the said accused persons had physically and mentally - 4 - HC-KAR CNR: KAHC010453002026 NC: 2026:KHC:36803 CRL.P No. 9712 of 2026 tortured her. However, there is no mention of any specific act committed by the accused persons named in the FIR, which would have abetted or instigated the deceased persons to commit suicide. Investigation of the case is completed and charge sheet has been filed. Accused NO.1 in the charge sheet had been granted regular bail in Crl.P.No.17685/2025 disposed of on 02.02.2026. Considering the nature of the allegations found against petitioner in the FIR as well as in the charge sheet the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.315/2025 registered by Suddaguntepalya Police Station for the offences punishable under Sections - 5 - HC-KAR CNR: KAHC010453002026 NC: 2026:KHC:36803 CRL.P No. 9712 of 2026 107 and 108 read with Section 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
