Mr. Madhu Jana Ms. Puja Sonkar …for the State Pursuant to an earlier order passed by this Court, report is submitted by the Block Land and Land Reforms Officer, Panskura-II, Kolaghat, Purba Medinipur. It appears from the report that field enquiry and demarcation were held by the concerned Revenue Inspector and it was found that the width of the government plot no. 633 in front of the petitioner’s house in plot no. 680 was 13.5 ft. on the western side and 14.5 ft. on the eastern side. The width of the concrete road constructed over the said plot in front of the petitioner’s plot was 7.83 ft. on the western side and 7.16 ft. on the eastern side. The petitioner was found to have encroached upon 225 sq. ft. of plot no. 633 belonging to the government. However, the concrete road was found to be free from encroachment. The sketch map annexed to the report demonstrates the said position. The demarcation was held in presence of the petitioner, the private respondent, the Panchayat Pradhan, Panchayat member and other persons of the locality. In view of such demarcation, it is crystal clear that the boundary wall raised by the petitioner has encroached upon plot no. 633 which is a path. By the order impugned dated August 26, 2025, the Additional District Magistrate and District Land and Land Reforms Officer, Purba Medinipur directed that the unauthorized boundary wall erected by the petitioner be demolished forthwith and the public road restored to its original condition. The order does not suffer from any illegality or irregularity and does not call for interference by this Court. The writ petition is accordingly dismissed. The authorities referred to in the order impugned are directed to implement the order forthwith. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
