::1:: (225) IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-17732-2026 (O & M) Date of Decision: 14.07.2026 Pammi ... Petitioner Versus UT Chandigarh ...Respondent CORAM: HON'BLE MR. JUSTICE JASJIT SINGH BEDI Present: Mr. Deepak Jaglan, Advocate with Mr. Rajat Narwal, Advocate for the petitioner. Mr. Manish Bansal, Public Prosecutor for UT Chandigarh with Mr. Dixit Bhardwaj, Advocate, Mr. Arjun Garg, Advocate and Mr. Sarasmi Budhiraja, Advocate for the respondent. **** JASJIT SINGH BEDI, J. The prayer in the present petition under Section 483 BNSS is for the grant of regular bail to the petitioner in case bearing FIR No.88 dated 07.07.2025 under Sections 103(1), 3(5) of BNS, 2023 (Sections 302 and 34 IPC), registered at Police Station Maloya, Chandigarh. 2. The learned counsel for the petitioner contends that though the petitioner is duly named in the FIR, during the course of the Trial, all the material witnesses have not supported the prosecution case qua the petitioner. As the petitioner is in custody since 08.07.2025 but only 09 of the 32 prosecution witnesses have been examined so far, the Trial of the present case VISHAL SETHI 2026.07.14 17:58 I attest to the accuracy and integrity of this document ::2:: is not likely to be concluded anytime soon and therefore, the petitioner is entitled to the concession of regular bail. 4. The learned counsel for the UT has not disputed the factual assertion that none of the witnesses have supported the prosecution case qua the petitioner. He, however, concedes that the petitioner is in custody since 08.07.2025 but only 09 of the 32 prosecution witnesses have been examined so far. 5. I have heard the learned counsel for the parties. 6. Admittedly, all the prosecution witnesses have turned hostile against the petitioner. Whether the remaining evidence is sufficient to establish the culpability of the petitioner shall be adjudicated upon during the course of the Trial. The petitioner is stated to be in custody since 08.07.2025 but only 06 out of the 32 prosecution witnesses have been examined so far. Therefore, the Trial in the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioner is not required. 7. Thus without commenting on the merits of the case, the present petition is allowed and the petitioner-Pammi is ordered to be released on bail subject to her furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 8. The petition stands disposed of.
