Bhagwan Singh vs. State 2023:RJ-JP:20893 "Undisputedly, the incident relates back to the year 1983 and the appellant Bhagwan Singh has so far undergone a period of 6 days in custody out of total sentence of three years R.I. Presently, he is an old man of nearly 71 years so also he suffered agony and trauma of protracted trial. Thus, looking to the over-all circumstances and the case laws cited by learned counsel for the appellant as also the fact that the appellant Bhagwan Singh has remained behind the bars for some time, it will be just and proper, if the sentence awarded by the trial court for offence under Sections 326, 325 and 323 of IPC is reduced to the period already undergone by the appellant while enhancing the fine amount."
