Pursuant to the order dated 6th March, 2026, a communication dated 16th March, 2026 of Inspector- in-Charge, Domjur Police Station, Howrah Police Commissionerate is placed before this Court and same is taken on record. Copies of the said communication dated 16th March, 2026 are made over to the learned advocates representing the petitioners and the private respondents. 3. It is disclosed in the communication dated 16th March, 2026 that police authorities are not standing in the [2] way regarding ingress to and egress from the land in question. It is further disclosed that though police authorities are keeping vigil over the said land in question but they will not create any hindrance with regard to ingress and egress of the parties to this writ petition. 4. It needs to be recorded herein that a title suit is pending being T.S. No.1363 of 2024 wherein ad interim order was passed on 1st October, 2024 by the learned Civil Judge (Junior Division), 4th Court, Howrah thereby restraining the defendant nos.1 to 5 and their men and agents from creating any disturbance to the free movement of the plaintiff and its men and agents to use the first schedule lands through the second schedule plots of land and was further restrained from preventing free ingress and egress to and from the scheduled land. Though order dated 1st October, 2024 was passed ex-parte but vide subsequent order dated 10th December, 2025, said ad interim order was extended till 8th April, 2026. 5. In view of pendency of the aforesaid title suit, this Court will not pass any order deciding inter se right of the parties to this writ petition relating to ingress and egress to and from the land in question. [3] 6. However, Court directs the concerned police authorities to keep vigil over the place in question and to maintain peace and tranquility at the locale. 7. Parties shall be at liberty to approach the appropriate forum in pursuit of remedies. 8. Writ petition stands disposed of. 9. Urgent photostat certified copy of the order, if applied for, be given to the parties upon usual undertakings. (SAUGATA BHATTACHARYYA, J.)
