Mr. Krishnendu Bera Mr. Raja Ghosh … for the Petitioner. 1. Affidavit of service filed in Court today be kept with the records. 2. The petitioner claims to be serving as Group-D staff in a school from the year 2001. His service was, however, approved in the year 2009 and he retired from service on October 31, 2022. 3. While the petitioner was in service, he applied before the authority in the year 2013 mentioning that he was not paid his salary in the proper scale from the date of his appointment till the date of approval of his service. There was no response from the end of the authority. 4. In September 2024, the petitioner claims to have filed a representation before the authority seeking benefit of his past service from the year 2001 till the date of his approval of appointment in the year 2009. The same is alleged to be kept pending. 5. Prayer has been made to direct the respondent authorities to consider the representation filed by the petitioner claiming benefit of his past service. 2 6. None appears on behalf of the State respondents. 7. On a perusal of the documents annexed to the writ petition, it appears that the petitioner remained in service from 2009 till his retirement in October 2022. During the entire tenure, he never approached the authority for granting benefit of his past service. 8. After retirement the petitioner claims to have filed a representation in September 2024 seeking financial benefit of his past service. The said representation also does not bear any proof of service upon the respondents. 9. In view of the above, the instant writ petition stands disposed of with the observation that it will be open for the petitioner to serve a copy of the subject representation dated September 3, 2024 annexed as P/14 to the writ petition upon the District Inspector of Schools (SE), Paschim Medinipur. 10. If the said representation is served upon the authority, the same shall be considered by the aforesaid respondent in accordance with law within a period of twelve weeks from the date of submission of the same. 11. The fate of the representation shall be made known to the petitioner immediately thereafter. 12. It is made clear that this Court has not entered into the merits of the claim of the petitioner and all points are left open to be decided by the aforesaid 3 respondent at the time of consideration of the said representation. 13. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court. 14.
