This is the second bail application filed under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.28/2026 registered at Outpost Devarbija Police Station Bemtara, District Bemtara (C.G.) for the offence punishable under Sections 20(b) of the Narcotics Drugs Psychotropic Substance, 1985.
2. The first bail application of the applicant was rejected on merits by this Court vide order dated 08.04.2026 passed in MCRC No.3179/2026.
3. Case of the prosecution, in brief, is that the Police of Police Station – Bemetara, District- Bemetara, (C.G.), had received secret information DEEPTI JHA Digitally signed by DEEPTI JHA
2 from the informant and on the basis of the said information conducted a raid and seized total 25.890 Kg of Ganja from the possession of the present applicant. Thereafter, the Police has registered the ofence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 against the present applicant. Hence, the bail application.

Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case and the alleged contraband article was not recovered from the exclusive possession of the present applicant and no any contraband article has been seized from the applicant. He also submits that the present applicant has been arrested only on the basis of suspicion. He further submits that out of four witnesses, 2 have been examined, who turned hostile and two are remaining. He also submits that the applicant has no previous criminal antecedents, the charge-sheet has been submitted before the competent Court, and he is in jail since 18.01.2026 and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 5. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the quantity of contraband article i.e. total 25.890 Ganja from the possession of the present applicant, which is much above the commercial quantity, as such, the applicant is not entitled to be released on bail. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Considering the facts and circumstances of the case and further the
3 fact that the seized contraband article i.e. total 25.890 Kg of Ganja from the possession of the present applicant, is much above the commercial quantity and the applicant has failed to give any explanation for the same. Further, considering the fact that out of 4 witnesses, 2 were examined, who turned hostile and further it cannot be a case of false implication and also there is no new ground to grant the bail, therefore, I am not inclined to release the applicant on bail. 8. Accordingly, this first bail application of applicant – Jagesh Verma @ Jambo, involved in Crime No.28/2026 registered at Outpost Devarbija Police Station Bemtara, District Bemtara (C.G.) for the offence punishable under Sections 20(b) of the Narcotics Drugs Psychotropic Substance, 1985, is rejected at this stage. 9. However, this Court hopes and trusts that the trial Court shall make earnest endeavour to conclude the trial expeditiously, preferably within a period of six months from the date of passing of this order, if there is no legal impediment. 10.
