JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 2 20-08-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in connection with Khushrupur P.S. Case No. 257 of 2026, instituted for the offences punishable under Sections 115(2), 126(2), 118(2), 352, 351(2), 351(3) of the B.N.S. 3. As per the prosecution case, on the date of occurrence, when the informant was returning from his field, on the way, petitioner caught him and abused him and demanded extortion of Rs. 2,00,000/-. On being said that he has no money, petitioner assaulted him with iron rod causing injury. The petitioner also threatened the informant to leave his house and go away to his son's place otherwise he will be killed. 4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. There is land dispute between the parties and the informant being Patna High Court CR. MISC. No.57512 of 2026(2) dt.20-08-2026 2/2 the uncle of the petitioner wants to grab the land and due to malafide, he has lodged the F.I.R. against the petitioner. Petitioner is 60% disabled person. Informant has not sustained any serious injury. He further submits that in the F.I.R. itself it is stated that there was some scratches due to assault by the petitioner. Petitioner has one criminal antecedent in which he is on bail. Petitioner undertakes to co-operate in the investigation and trial. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail. 6. Considering the facts and circumstances of the case, submission of learned counsel for the parties and there is land dispute between the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Patna City in connection with Khushrupur P.S.
