Vishal Kumar ... For the State. Learned advocate appearing for the petitioners submits that 38 bottles of Codeine Phosphate in different forms were recovered from other accused persons. So far as the present petitioners are concerned, they have been implicated on the basis of statement of co-accused. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that investigation of the case is still in progress. Learned advocate for the petitioners has submitted photostat copy of the charge-sheet. Let the same be kept with the record. Having considered the quantum of seizure in the present case and the fact that petitioners have been implicated on the basis of statement of co-accused, I am 2 inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed. Accordingly, the petitioners viz., 1. Tejamul Rahaman Khan @ Tejamul Rahaman @ Tejamul Khan and 2. Situn Mandal shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 3rd Court, Malda. If on bail, the petitioners shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Malda without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 1359 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
