In that view of the matter, following the declaration of law made by the Hon'ble Supreme Court in the case of Tarachandra vs. Bhawarlal & Anr., reported in 2025 SCC Online SC 2902, I am of the view that, the impugned endorsement at Annexure-A issued by the respondent No.4 is set aside and matter is remitted to the respondent No.4 to re-consider the claim of the petitioner in accordance with the judgment of the Hon'ble Supreme Court in the above case, within a period of two months from the date of receipt of certified copy this order.
