Mr. Sourav Lohani …For the De facto Complainant. 1. This is the second application for grant of pre-arrest bail. 2. The victim appears through learned Counsel and submits before the Court that the parties were friends and they had personal disagreement, which led her to file the complaint in a state of anger. She is present in Court. It is stated that she is happily married elsewhere and there is no animosity between the parties now. 3. According to Mr. Chakraborty, the above situation is a changed circumstance and the application for pre-arrest bail is maintainable. 4. Considering such facts, the prayer for pre-arrest bail is allowed. 2 5. Accordingly, this Court directs that, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the B.N.S.S. 2023. The petitioner shall appear before the Investigating Officer once a month. The petitioner shall not intimidate witnesses or tamper with evidence in any manner whatsoever. 6. In default, the jurisdictional court shall be at liberty to cancel the bail without further reference to this court. 7. The application for anticipatory bail is, thus, disposed of. 8.
