2 bail to the applicants who have been arrested in connection with Crime No. 42/2025 registered at Police Station – Nagarnaar, District: Bastar at Jagdalpur (C.G.), for the offences under Section 20 (b) (ii) (C) of NDPS Act.

Brief facts of the case are that, on 28.02.2025, the police of Police Station Nagarnar, District Bastar, allegedly received a secret information that two persons were standing near Jagannath Mirchi Badi on NH-63 carrying black backpacks containing contraband Ganja. Acting upon the said information, the police party proceeded to the spot along with independent witnesses, served notices under the provisions of the NDPS Act, and conducted the search of the accused persons. During the search, four packets containing suspected Ganja were allegedly recovered from two black backpacks carried by the accused persons. The recovered contraband was weighed and found to be 21.046 kilograms of contraband article Ganja. The police seized the contraband along with mobile phones and cash from the accused persons, completed the seizure and arrest formalities, and thereafter registered Crime No. 42/2025 at Police Station Nagarnaar, District Bastar at Jagdalpur (C.G.). Based on the aforesaid allegations, the police registered the offences as mentioned above against the present applicants. Hence, this

Learned counsel for the applicants submits that the applicants is innocent and has been falsely implicated in the present case and he is in incarceration since 01.03.2025. It is argued that no contraband has been seized from the exclusive possession of the applicants. He further submits that conclusion of trial is likely to take considerable time, therefore, it is prayed that he may be enlarged on regular bail.
4. On the other hand, learned Counsel for the State opposes the bail application and submits that charge-sheet has been filed before the Competent Court.
5. I have heard learned counsel for the parties and perused the material available on record.
6. Considering the facts and circumstances of the case and further the fact that a commercial quantity of 21.046 kg of Ganja has been seized from the possession of the applicants, this Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail.
7. Accordingly, the bail application of the Applicant No. 1- Divya Mohan Khora and Applicant No. 2 – Ajay Kuldeep, involved in Crime No. 42/2025 registered at Police Station – Nagarnaar, District: Bastar at Jagdalpur (C.G.), for the offences under Section 20 (b) (ii) (C) of NDPS Act, is
4 rejected.
8. However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial as expeditiously as possible within a period of six months from the receipt of a certified copy of this order in accordance with law, if there is no legal impediment.
