Initially, the petitioner filed a proceeding under Section 12 of the Protection of Women against Domestic Violence Act, 2005 against her husband being Misc D.V. Case No.151 of 2024. 5. Subsequently, the case was again transferred to 2 the Learned Chief Judicial Magistrate, Coochbehar. At the time of filing of the proceeding, the petitioner was residing with her husband at Coochbehar. Subsequently, owing to her ailments and torture meted out upon the petitioner by her husband and other in-laws, the petitioner had to take residence at the matrimonial house of her daughter at Siliguri. Petitioner also contends that it will be burdensome on her part to pursue the case at Coochbehar whereas she has taken residence at Siliguri.
