JUSTICE ASHOK S.KINAGI ORAL ORDER The petitioners have filed this writ petition seeking the following reliefs: (1) Issue a writ in the nature of certiorari or such other appropriate writ, order or direction, quashing the impugned show cause notice dated 20.05.2026 in No.DPUE-EST 30NN (HOKA)/5/2023-1049795 issued by the 4th respondent – The Director, Education Department (Pre University) 18th Cross, Malleshwaram, Bengaluru-12 which is produced and marked as Annexure-L to the writ petition and; (2) Issue a writ of mandamus directing the respondent No.4 to consider letter dated 23.06.2026 vide Annexure-K and thereby direct to furnish the legal notice dated 13.03.2026, report dated 08.04.2026 and another legal notice dated 31.01.2026 in the interest of justice and equity. Brief facts leading rise to the filing of these writ petition are as follows: Respondent No.7 issued a legal notice to respondent No.4 alleging that the petitioner-Institution is not having valid title and not having amenities to run the institution. Respondent No.4 issued a show cause notice dated 20.05.2026 to the petitioner alleging that the College is running contrary to Section 39 of the Karnataka Education Act, 1983. Hence, the sanction will be cancelled and further directed to reply within 15 days. Pursuant to the show cause notice, the petitioner has replied to the show cause notice. Respondent No.4 without passing any order, insisting the petitioner to stop running of the institution or may cancel the sanction/permission issued to petitioner No.1-Trust. Hence, this writ petition. 3. Learned Government Advocate submits that respondent No.4 will consider the reply and pass an appropriate order. Till passing an order, respondent No.4 - 5 - HC-KAR NC: 2026:KHC:35256 WP No. 20853 of 2026 will not insist the petitioner to close down or cancel the permission granted to the petitioner. 4.
