SONI SHRIVASTAVA ORAL ORDER 2 19-08-2026 Heard learned counsel for the petitioners as well as the informant and learned Additional Public Prosecutor for the State. 2. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 329(4), 126(2), 115(2), 118(1), 117(2), 109, 74, 76, 3(5) of the BNS. 3. As per the prosecution case, the petitioners are said to have assaulted the informant and his family members with sharp weapon and lathi. 4. Learned counsel for the petitioners submits that the Patna High Court CR. MISC. No.57645 of 2026(2) dt.19-08-2026 2/3 present case has been lodged against the petitioners, who happen to be close agnates of the informant on account of a dispute with regard to Boring, which is evident from the First Information Report itself. It is further submitted that a counter case has also been filed on behalf of the petitioners (Annexure- P/2) indicating acts of assault at the ends of the present informant and others causing injuries with excessive bleeding etc. for which the petitioner was even admitted into the hospital. It has further been submitted that so far as the injuries on the side of the informant and two others are concerned, they are all simple in nature and mostly caused by hard and blunt object except for one, which is on the wrist of the wife of the informant. The petitioners are persons of clean antecedent and the other allegations made are purely ornamental in nature. 5. Learned APP for the State has opposed the application for anticipatory bail. 6. Taking into consideration the facts and circumstances and also considering that there is case and counter case between the parties, who are close agnates resulting in injuries on both sides, let the above named petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, Patna High Court CR. No.57645 of 2026(2) dt.19-08-2026 3/3 be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Konch P.S.
