WA(MD)No.625 of 2026 JUDGMENT (Judgment of the Court was made by N.SATHISH KUMAR, J.) Challenging the order of the learned Single Judge directing the respondents to reconsider the petitioner's application for compassionate appointment, the respondent in the writ petition has filed the present appeal.
2. The writ petitioner's father died in harness on 10.04.2008. While still a minor, the petitioner submitted an application on 08.04.2011, which was within three years from the date of his father's death. However, the application was rejected within three days on the ground that the petitioner was a minor. Further, the said rejection order was not communicated to the petitioner. Therefore, the petitioner filed the writ petition. The learned Single Judge disposed of the writ petition by directing the respondent to reconsider the petitioner's application.
3. We are of the view that no positive direction has been issued by the learned Single Judge. The direction was only to consider the 2/4 https://www.mhc.tn.gov.in/judis
WA(MD)No.625 of 2026 petitioner's application for compassionate appointment. A mere direction to consider an application does not imply that compassionate appointment must necessarily be granted. Compassionate appointment has to be considered in light of various relevant factors and cannot be claimed as a matter of right.
4. In such circumstances, we find no merit in the writ appeal. Accordingly, the writ appeal stands dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
