And In the matter of: Nandeswar Barman & Ors. ….Petitioners. Mr. Subhasish Misra Mr. Satyajit Paul Mr. Rounak Ghosh …for the Petitioners. Mr. Avrojyoti Das Mr. Gobinda Ghosh Ms. Madhushri Dutta … for the State. The petitioners pray for anticipatory bail. Petitioner no. 1 is the husband and the petitioner nos. 2 to 6 are the relatives/in laws of the victim. Having considered the complaint, the materials on records and the statement of the witnesses recorded during the course of the investigation it appears that the investigation is yet to be completed. However, considering the nature of the allegation and the role played by the husband, the prayer for pre-arrest bail by the petitioner no. 1, namely, Nandeswar Barman, is rejected. With regard to the petitioner nos. 2 to 6 who are the in laws, this court directs that the in the event of arrest, the petitioner nos. 2 to 6, namely, Chandeswar Barman, Bhanu Mati Barman, Minu Barman @ Minati Barman, Budheswar Barman and Madan 2 Biswasharma @ Madan Biswakarma shall be released on bail upon furnishing a bond of Rs.20,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the B.N.S.S. 2023. The petitioner nos. 2 to 6 shall not intimidate witnesses or tamper with evidence in any manner whatsoever. The petitioner nos. 2, 5 and 6 shall meet the investigating officer once in a fortnight and cooperate till conclusion of the investigation. In case the petitioner nos. 2 to 6 fail to adhere to any of the conditions stated above, the learned jurisdictional court shall be entitled to cancel the bail without further reference to this court. The application for anticipatory bail, thus, disposed of. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Shampa Sarkar, J.)
