The petitioner applied for general transfer in prescribed form. Mr. Lahiri, learned advocate appearing for the petitioner submits that the application has been submitted through the concerned school. He further submits that the school authorities have not yet issued the no-objection certificate in favour of the petitioner for consideration of her prayer for transfer. 2 Heard the learned advocate for the State. Learned advocate appearing for the petitioner submits that the school authorities and the West Bengal Central School Service Commission have been duly served. Since a transfer application has been submitted and the petitioner has already approached the concerned school for no- objection, this writ petition stands disposed of with the following directions: i) The Head of the institution of Tarijote Junior High School, being the 6th respondent, is directed to consider the prayer of the petitioner for issuance of no-objection for transfer and take necessary steps in accordance with law and communicate its decision to the petitioner as expeditiously as possible but positively within a period of three weeks from the receipt of a server copy of this order. ii) If the 6th respondent decides in favour of the petitioner, the papers along 3 with such no-objection shall be forwarded to the District Inspector of Schools (SE), Siliguri immediately thereafter. iii) The District Inspector of Schools (SE), Siliguri, being the 5th respondent, shall consider the prayer of the petitioner for general transfer in the light of the relevant notification governing the field and decide such application by passing a reasoned order as expeditiously as possible but positively within a period of six weeks from the date of receipt of the no- objection and other relevant papers from the school authority. iv) In case the District Inspector of Schools (SE), Siliguri, being the 5th respondent, decides in favour of the petitioner, such decision along with the relevant materials and papers shall be forwarded to the Secretary, West Bengal Central School Service Commission, being the 4th respondent, who shall pass an order strictly in accordance with law as 4 expeditiously as possible but positively within a period of four weeks from the receipt of the papers from the District Inspector of Schools. v) It is, however, made clear that this Court has not entered into the merits of the claim made by the petitioner in the transfer application and all the points are left open to be decided by the respondent authorities in accordance with law.
