20.07.2026 Court No.35. D/L.895. Rakib (Allowed) CRM (A) 805 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Mahishadal Police Station case no. 433 of 2025 dated 20.10.2025 under Sections 80/85/61(2)/103(1) of the Bharatiya Nyaya Sanhita, 2023 read with under Section 4 of the Dowry Prohibition Act, 1961. And In the matter of : Manoj Mondal & Anr. ……Petitioners. Mr. Shraman Sarkar Mr. Sahil Kabir Mr. Md. Tehsin Reja .....for the Petitioners. Mr. Pinaki Bhattacharyya, Sr. Govt. Adv, Mr. Amartya Mohan Bhattacharyya ……for the State. Learned advocate appearing for the petitioners submit that petitioners are the parents-in-law of the deceased. The husband was arrested in the present case and subsequently he has been granted bail, charge-sheet has already been submitted before the jurisdictional Court. Learned advocate appearing for the State opposes the prayer for anticipatory bail. On query from this Court, it has been specifically stated that there are no evidence of poison which was administered rather the materials show that the deceased consumed poison and succumbed. Having considered that charge-sheet has already been submitted, I am inclined to grant anticipatory bail to the present 2 petitioners. Accordingly, the prayer for anticipatory bail of the petitioners is allowed. As such, I direct that in the event of arrest, the petitioners shall furnish bonds subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge-sheet has already been submitted, this order of anticipatory bail will remain valid for a period of six weeks from date. Accordingly, CRM (A) 805 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
