Learned advocate appearing for the petitioner submits that the petitioner in spite of being in custody for more than two years only part of the PW1 has been examined till date. Learned advocate appearing for the State submits that there has been alleged recovery of 9500 bottles of phensedyl and the petitioner is the driver of a vehicle. Having considered the huge quantity of contraband seized, without the evidence of the independent witnesses being examined, I am not inclined to release the petitioner on bail because of the rigors of Section 37 of the NDPS Act is attracted. Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1310 of 2026 is dismissed.
