Kausik (Allowed) CRM (NDPS) 1305 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Gazole Police Station Case No. 476 of 2025 dated 21.05.2025 under Sections 21(c)/25/27A/29 of the NDPS Act, 1985. And In the matter of : Md. Abdul Quadir @ Shammi Sk @ Sammi ……Petitioner. Mr. Mrityunjoy Chatterjee Mrs. Suchismita Chakraborty Mr. Debarnab Adhikary ……for the Petitioner. Mr. Sagar Saha Ms. Nayana Mukhopadhyay ……for the State. Learned advocate appearing for the petitioner submits that although there is recovery of more than 5 Kgs. 635 Gms. of Brown Sugar but so far as the complicity of the present petitioner is concerned, he has been arrested on the basis of statement of the co-accused and there has been no recovery from him. Charge sheet has already been submitted and the prosecution has relied upon 16 witnesses in order to prove its case. As such the petitioner prays for bail on any stringent condition. Learned advocate for the State opposes the prayer for bail. 2 Having considered that there has been no recovery from the present petitioner, I am inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Md. Abdul Quadir @ Shammi Sk @ Sammi shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1305 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
