The petitioner has filed this petition seeking the following reliefs: “10.1 This Hon'ble Court may kindly be pleased to issue an appropriate writ/direction/order commanding the respondents to continue the Petitioner in the project like others. 10.2 The Hon'ble Court further be pleased to issue an appropriate writ/direction/order commanding the respondents to absorb the petitioner in other Govt. project/sector. 10.3 The respondent authorities may be directed to release salary of the petitioner for Nov. 2020 till the date with bank rate interests. 10.4 Any other relief(s), which may deems fit, looking to the facts & circumstances of the case may be given to the Petitioners.” 2. The facts, as narrated, are that the petitioner was appointed as WDT (Member) under the respondents vide order dated 21.4.2010 on a contractual basis. The services of the petitioner were discontinued with effect from 31.10.2020. The petitioner has sought a direction to the respondents to appoint him in a similar project and to absorb his services. Reliefs 10.1 & 10.2 sought for by the petitioner cannot be granted as the petitioner has the right to apply for appointment if any advertisement is issued by the concerned department for appointment 3 in a similar project. Insofar as the prayer for absorption of his services is concerned, in the absence of any statutory rules providing for such absorption, no such direction can be issued. Furthermore, as the petitioner is no longer in service, his services having been discontinued with effect from 31.10.2020, no such order can be passed. 3. With regard to relief 10.2, the petitioner would be at liberty to make a representation before the Competent Authority. If such a representation is made, the authority concerned shall consider and decide the claim of the petitioner after verifying the relevant facts, in accordance with law. 4.
