JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in Crime No.146/2026 registered by Yeshwanthapura Police Station, Bengaluru for offence punishable under Section 103(1) of BNS Act, 2023 is before this Court in this petition filed under Section 482 of BNSS Act, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the petitioner and the learned HCGP for respondent-State. 3.FIR in Crime No.146/2026 was registered by Yeshwanthapura Police Station, Bengaluru for the aforesaid offence against the petitioner herein, based on the first information dated 03.05.2026, received from Prashanth who is her husband. Apprehending arrest, in the said case, petitioner had filed Criminal Misc. Case No.4880/2026 before - 3 - HC-KAR CNR: KAHC010377232026 NC: 2026:KHC:36460 CRL.P No. 7851 of 2026 the Jurisdictional Sessions Court, which was rejected on 29.05.2026. Therefore, she is before this Court. 4. In the First Information dated 03.05.2026 submitted by the husband of the petitioner, he has stated that his marriage with the petitioner was performed on 31.10.2021 and from the said wedlock they had two children named Nivedh aged about four years and Nirmal aged about one and half years. In the first information, it is alleged that petitioner was in the habit of quarrelling with her husband on petty issues and on 02.05.2026 at about 08.30 a.m., she had requested him to purchase pesticides for the cockroaches in their house. First informant thereafter, took his wife to a medical shop and purchased three packets of rat poison and had handed over the same to his wife. When he returned home at about 09.30 p.m., on the said day, he found that the door of his wife's room was locked and therefore he slept in the hall of the house. 5. On 03.05.2026 at about 07.00 a.m. he went outside, purchased eggs and came back home at about 08.30 a.m. Petitioner who came out of her room informed him that she - 4 - HC-KAR CNR: KAHC010377232026 NC: 2026:KHC:36460 CRL.P No. 7851 of 2026 had fed the rat poison to their children and killed them and asked him to kill her. Immediately thereafter, the first informant took his wife and children to Manipal Hospital at Yeshwanthapura and the Doctors in the hospital declared that the children were dead and petitioner who had also consumed rat poison was admitted in the hospital. It is in this background FIR was registered against the petitioner for the aforesaid offences on 03.05.2026. 6. Petitioner who was admitted in Manipal Hospital at Yeshwanthpura was discharged from the said hospital after a period of one month. The police have not made any attempt to arrest her during the said period, nor was any attempt made to record her statement while she was in the hospital for a period of nearly one month. 7. Considering the nature of allegations as against the petitioner, I am of the opinion that her custodial interrogation may not be required. She has undertaken to co-operate with the police for the purpose of investigation. - 5 - HC-KAR CNR: KAHC010377232026 NC: 2026:KHC:36460 CRL.P No. 7851 of 2026 8. Under the said circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following: ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of her arrest in Crime No.146/2026 registered by Yeshwanthapura Police Station, Bengaluru, for the offences punishable under Section 103(1) of BNS Act, 2023, subject to the following conditions: i. Petitioner shall appear before the Investigation Officer in the present case on 30.07.2026 at 10.30 a.m., and on the said day, the Investigation Officer is at liberty to take the petitioner to custody for the purpose of interrogation. However, it is made clear that on the very same day, on or before 6.00 pm., the petitioner shall be released subject to he executing a personal bond for a sum of - 6 - HC-KAR CNR: KAHC010377232026 NC: 2026:KHC:36460 CRL.P No. 7851 of 2026 Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigation officer; ii. Petitioner shall regularly appear before the Trial Court on the date of hearing without fail unless exempted by the Trial Court for valid reasons; iii. Petitioner shall not tamper with the prosecution witness and she shall co-operate with the police for investigation and appear before them whenever called upon; iv.
