SONI SHRIVASTAVA ORAL ORDER 2 19-08-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 318, 221, 223, 132, 61(2) of the Bhartiya Nyaya Sanhita, 2023 and under Section 3/4 of Bihar Examinations Conduct Act, 1981. 3. The allegation in the F.I.R. is that the petitioner had provided some chit to one of the examinee of the Constable Recruitment Examination. 4. Learned counsel for the petitioner submits that the petitioner is a teacher and the allegation against him that he had provided some chit to one of the examinee of the Constable Recruitment Examination is only based on suspicion, as he had Patna High Court CR. MISC. No.57173 of 2026(2) dt.19-08-2026 2/3 been seen outside the room of the said candidate. It is further submitted that the said chit is not in the handwriting of the petitioner and the same is being connected with the petitioner only on the basis of suspicion. Moreover, the petitioner is a government servant and is posted in a higher secondary school, as such, there is no flight risk and he undertakes to fully cooperate with the investigation. Further, the petitioner has no criminal antecedent. 5. Learned APP for the State opposed the prayer for anticipatory bail on the basis of allegations made in the First Information Report. 6. Taking into consideration the facts and circumstances of the case and also considering the fact that the allegation against the petitioner is based upon suspicion and he being a Government teacher, there is no flight risk, let the above named petitioner, who has no criminal antecedent, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Town Thana Ara (Bhojpur) P.S. Case Patna High Court CR. MISC.
