JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.2 in Crime No.46/2026 registered by Chikkamagaluru Rural Police Station, Chikkamagaluru, for the offence punishable under Section 108 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, is before this Court in this criminal petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.46/2026 was registered by Chikkamagaluru Rural Police Station, for the aforesaid - 3 - HC-KAR CNR: KAHC010463342026 NC: 2026:KHC:36500 CRL.P No. 9992 of 2026 offence against one Basavaraja Sheelavantar and the petitioner herein on the basis of the first information dated 06.02.2026 received from Venkatesha S/o Gangappa, who is brother of deceased-Smt.Rajeshwari. Apprehending arrest in the said case, the petitioner along with accused No.1-Basavaraja Sheelavantar had filed bail petition in Crl.Misc.No.120/2026 before the jurisdictional Sessions Court and the same was rejected as against the petitioner on 16.03.2026. Therefore, the petitioner is before this Court. 4. Learned Counsel for the petitioner having reiterated the grounds urged in the petition, prays to allow the petition. 5. Per contra, learned High Court Government Pleader has opposed the bail petition and prays to dismiss the petition. 6. Perusal of the first information would go to show that deceased-Rajeshwari, who was married, had developed intimacy with accused No.1-Basavaraja - 4 - HC-KAR CNR: KAHC010463342026 NC: 2026:KHC:36500 CRL.P No. 9992 of 2026 Sheelavantar and he allegedly had borrowed money from her. It appears that accused No.1 had not repaid the money borrowed from her. The allegation as against the petitioner herein is that she had intervened and asked the deceased to settle the dispute with accused No.1. Accused No.1 has been granted anticipatory bail by this Court in Criminal Petition No.10010/2026, disposed of on 13.07.2026. Petitioner is a married lady and she has undertaken to cooperate with the police for the purpose of investigation. Under these circumstances, I am of the considered opinion that the prayer made by the petitioner for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following: ORDER (i) The Criminal Petition is allowed. (ii) The Respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of her arrest in Crime No.46/2026 registered by Chikkamagaluru Rural Police Station, - 5 - HC-KAR CNR: KAHC010463342026 NC: 2026:KHC:36500 CRL.P No. 9992 of 2026 Chikkamagaluru, for the offence punishable under Section 108 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, subject to the following conditions: 1. Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (one lakh only) with two sureties for the likesum to the satisfaction of the Investigating Officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
