Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 38 bottles of Phensedyl and during pendency of the bail application, charge-sheet has already been submitted. Learned advocate appearing for the State has produced a report dated 09.07.2026 which reflects that on 30.06.2026, charge-sheet has already been submitted before the jurisdictional court. Having considered that prosecution has relied upon 16 witnesses in support of its case which will consume some time, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Ganesh Mandal shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be 2 local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Malda without prior permission of the learned Special Court. Report dated 09.07.2026 enclosing certified copies of charge-sheet submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1350 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
