2 Advocate General for the State/Respondents.
2. The present Petition has been filed by the Petitioner for the following reliefs:-
“10.1. Issue an appropriate writ, order or direction directing the respondent authorities to conduct a fair, impartial, effective and expeditious investigation in Crime No.95/2025 registered at Police Station Ambikapur Dehat (Gandhinagar), District Surguja (C.G.), strictly in accordance with law and to conclude the investigation within a time-bound period as may be deemed fit by this Hon'ble Court;
10.2. Issue such other or further writ, order or direction as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case, in the interest of justice.”
3. Learned Counsel for the Petitioner submits that though FIR bearing Crime No.95/2025 has been registered, the Respondent authorities have failed to conduct the investigation in a fair, effective and expeditious manner. It is further submitted that despite repeated representations made by the Petitioner to the concerned authorities as well as the superior police officers, no effective steps have been taken for completion of the investigation. He further submits that the allegations pertain to a large-scale financial fraud involving multiple investors and substantial public money and therefore, the unexplained delay in investigation is likely to result in disappearance of evidence and frustration of the criminal process. It is, therefore, prayed that appropriate directions be issued to the investigating agency to conclude the investigation
3 expeditiously in accordance with law.
4. On the other hand, learned State Counsel opposes the prayer made by the learned Counsel for the Petitioner and submits that the investigation is being conducted in accordance with law. He further submits that the investigating agency is taking all necessary steps for a fair and proper investigation and therefore, no interference by this Court is warranted and prays that the Writ Petition may be dismissed.
5. We have heard learned Counsel for the parties and perused the material available on record.
6. Considering the facts and circumstances of the case and the
submissions advanced by learned Counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation and submit the final report before the competent Court expeditiously, in accordance with law, if not already concluded, preferably within a period of four weeks from today.
