Learned advocate appearing for the petitioner submits that the petitioner is in custody since 14th January, 2026 and has been implicated only on the basis of vague circumstances. There are no materials to suggest that there are any available witness who has either seen the petitioner or there are circumstantial materials to connect the petitioner with the alleged crime. Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that although charge-sheet has been submitted but the report of the ballistic expert is pending. The empty cartridges which were seized from the place of 2 occurrence along with the firearm which has been seized pursuant to the statement of the present petitioner has been sent to the ballistic expert. Having considered the fact that the said issue is still pending, I am not inclined to release the petitioner on bail at this stage. State would put in efforts so that the ballistic expert opinion is made available within a period of one month. Petitioner would renew his prayer for bail after the report of the ballistic expert is submitted before the jurisdictional court. Accordingly, CRM(M)1260 of 2026 is dismissed.
