JUSTICE RANJAN KUMAR JHA ORAL ORDER 2 13-08-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in connection with Hasanpur P.S. Case No. 224 of 2021 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 3. The allegation in the F.I.R. is recovery of 27.540 liters from a motorcycle being driven and having a pillion rider. Also, after seeing the police party, the pillion rider fled away, and the person who was driving apprehended and disclosed his name as Sumit Purvey, and the said Sumit Purvey disclosed before the police the name of the person who was with Sumit Purvey as Amit Paswan. Accordingly, the petitioner has been made an accused. 4. Learned counsel for the petitioner submits that he has

The F.I.R. itself shows that petitioner has been arrayed as an accused on the basis of alleged disclosure of his name by Sumit Purvey before the police, and that he is also having clean antecedents. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail. 6. Having considered the submissions of the parties, the fact that there is no recovery from his physical possession nor is he connected with the motorcycle, the manner in which he has been made an accused and the further submission that the petitioner is having clean antecedents, let the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs.
10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Court – I, Samastipur in connection with Hasanpur P.S.
