CRM-M-36543-2026 (O & M) ::1:: (240) IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-36543-2026 (O & M) Date of Decision: 14.07.2026 Shubham ... Petitioner Versus State of Haryana ...Respondent CORAM: HON'BLE MR. JUSTICE JASJIT SINGH BEDI Present: Mr. Bhanu Pratap, Advocate for the petitioner(s). Mr. T.P. Singh, Sr. DAG, Haryana. **** JASJIT SINGH BEDI, J. The prayer in the present petition under Section 483 BNSS is for the grant of regular bail in case bearing FIR No.242 dated 26.06.2025 under Sections 109(1) and 3(5) of BNS, 2023 and later on added Section 238(a) of BNS, 2023 (Sections 307 and 34 IPC and later on added Section 201 of IPC) and Section 25 of the Arms Act, 1959, registered at Police Station Tehsil Camp, District Panipat. 2. The learned counsel for the petitioner contends that one Navam @ Nabham, the co-accused of the petitioner is alleged to have fired at the complainant though, no injury has been received by him. So far as the present petitioner is concerned, he was only standing alongside the main accused. As the petitioner is in custody since 21.02.2026 but none of the 18 prosecution witnesses has been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail. VISHAL SETHI 2026.07.14 17:58 I attest to the accuracy and integrity of this document CRM-M-36543-2026 (O & M) ::2:: 3. The learned counsel for the State, on the other hand, contends that the allegations levelled against the petitioner are grave inasmuch as he is accompanying the main accused. Therefore, the petitioner is not entitled to the concession as prayed for. He, however, concedes that the petitioner is in custody since 21.02.2026 but none of the 18 prosecution witnesses has been examined so far. 4. I have heard the learned counsel for the parties. 5. The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is in custody since 21.02.2026 but none of the 18 prosecution witnesses has been examined so far. Therefore, the Trial in the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioner is not required. 6. Thus without commenting on the merits of the case, the present petition is allowed and the petitioner-Shubham is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 7. The petition stands disposed of.
