Learned advocate appearing for the petitioner submits that petitioner is in custody for two years five months and only one independent witness has been examined by the prosecution which do not inspire any confidence, as such petitioner may be released on bail. Learned advocate appearing for the petitioner opposes the prayer for bail as there has been 225 kgs of ganja recovered from the present petitioner. I have taken into account the period of detention of the present petitioner which calls for interference of this Court. However, having regard to the quantum of seizure, as a matter of last chance, I direct the learned trial Court to complete the evidence of the other independent seizure list witnesses and if, after completion of the said seizure list witnesses the Court finds that the 2 petitioner has made out a case which somehow dilutes the seizure, in that case the learned trial Court on an application for bail of the petitioner will leniently consider the prayer for bail. Accordingly, the prayer for bail of the petitioner is dismissed. However, the learned trial Court would abide by the earlier directions. With the aforesaid directions, CRM (NDPS) 1317 of 2026 is disposed of at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
