Mr. Salahuddin Mr. Raziuddin …for the Petitioner 1. Affidavit of service filed by the petitioner is taken on record. In spite of service, none appears on behalf of the respondents. 2. Initially the father of the petitioner has made an application for grant of arm licence but during pendency of the said application, the father of the petitioner was murdered and accordingly, case has been initiated against the miscreants who were involved in the murder of the father of the petitioner. Subsequent to the death of the father of the petitioner, the petitioner has made an application before the concerned authority for grant of arm licence in the name of the petitioner. On receipt of the application, reports have been called for, police authorities have submitted report in favour of the petitioner. On receipt of the report from the police authorities, hearing notices have given to the petitioner and the petitioner has appeared before the authorities at the time of hearing. Subsequently again the police authorities have called for the report and the Nakashipara Police 2 Station has submitted a report to the Superintendent of Police, Nadia informing that the petitioner is not involved in any criminal activities and is not supporter of any political parties. After receipt of the said report, again a notice was issued to the petitioner for hearing but in spite of the hearing, till date no final order has been passed either rejecting the request of the petitioner for grant of arm licence or allowing the petitioner for obtaining arm licence. Thus, the petitioner has filed the present writ application. 3. Heard the learned counsel for the petitioner and perused the materials on record. 4. This Court finds that the father of the petitioner was apprehending danger of his life and has applied for arm licence but before granting the arm licence the father of the petitioner was murdered. Subsequently the petitioner has made an application for grant of arm licence. The petitioner is also getting threatens from the miscreants and his life is in danger. The police authorities have submitted the report in favour of the petitioner stating that the petitioner is not involved in any criminal activities and is not involved with any political parties. Hearing was also conducted by the concerned authorities but in spite of the hearing, till date, no decision has been taken. 5. Considering the above, this Court finds that no purpose will be served by keeping the writ petition pending. Accordingly, the writ petition is disposed by directing the respondent No.3, the District Magistrate, 3 Nadia, Krishnanagar to consider the application of the petitioner for grant of arm licence and if necessary, the petitioner may be given an opportunity of personal hearing and to pass a reasoned and speaking order within a period of six weeks from the date of receipt of this order. 6. Accordingly, WPA 21240 of 2025 stands disposed of. 7. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. 8. Urgent Photostat certified copy, if applied for, be given to the parties upon compliance with all formalities. (Krishna Rao, J.)
