Kausik (Rejected) CRM (NDPS) 1291 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Farakka Police Station Case No. 247 of 2025 dated 24th June, 2025 under section 20(b)/21(C)/29 of the NDPS Act, 1985. And In the matter of : Rahamat Ali ……Petitioner. Mr. Avik Ghosh ……for the Petitioner. Ms. Arushi Rathore Mr. Saswata Chatterjee ……for the State. Petitioner earlier has emphasized the Court that the independent witnesses did not support the prosecution case, as such, prayed for bail. Charge sheet reflects that CSW 10 is the videographer. Having considered that the videographer till date has not been examined, I am not inclined to release the petitioner on bail considering the quantity of contraband seized. Accordingly, CRM (NDPS) 1291 of 2026 is dismissed. Learned Trial Court would prepone the examination of the videographer (CSW 10) preferably within a period of 3 months from the date of communication of this order. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
