Rakib (Rejected) CRM (NDPS) 1320 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with English Bazar Police Station case no. 192 of 2026 dated 11.02.2026 under Sections 21(C)/29 of the NDPS Act. And In the matter of : Anwar Sk & Anr. ……Petitioners. Mr. Kunal Ganguly .....for the Petitioners. Mr. Sagar Saha Ms. Nayana Mukhopadhyay ……for the State. The subject matter of the present case is relate to alleged recovery of 20 bottles of phensedyl from four persons including the present petitioners. Learned advocate appearing for the State submits that investigation of the case is still in progress. Having considered that investigation of the case is still in progress, I direct that if there are no further recoveries or seizures in the present case, the learned trial Court after the charge-sheet is submitted release the petitioners on bail on such terms and conditions as it deems fit and proper. As such, the prayer for bail of the petitioners before this Court is rejected. However, learned trial Court would abide by the directions passed above. Consequently, CRM (NDPS) 1320 of 2026 is disposed of. 2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
