This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, the B.N.S.S.) for grant of regular bail to the applicants who have been arrested in connection with Crime No.516/2025 registered at Police Station Balconagar Dist. Korba (C.G.), for the offence punishable under Section 103(1) of Bhartiya Nyay Samhita, 2023 (for short, the BNS). 2. As per the prosecution’s case, while working in Balco, the applicant developed love affair with the deceased – Shanti Chauhan and later on the love affair between them led to close relationship. 2 concealed his marital status and subsequently, the deceased came to know the marital status of the applicant, which led to frequent quarrels between them and ultimately, in order to get rid of her, the applicant committed murder of the deceased. Based on this, offence under the aforesaid section has been registered against the present applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. She submits that there is no direct evidence against the present applicant and the entire case is based on circumstantial evidence and that, there is delay of 16 days in lodging the F.I.R. and for this, there is no explanation. She next submits that the statement of material prosecution witnesses were also recorded by the Police after considerable delay. She further submits that the applicant is in jail since 18.08.2025 and that, trial is going on and it may take some time to conclude. On these premises, she prays that the applicant may be enlarged on bail. 4.
On the other hand, learned counsel for the State opposes the bail application and submits that the the accused/applicant and the deceased Shanti Chauhan were living together and the deceased was found dead due to strangulation of neck in the same house where the applicant was residing, therefore, the applicant is not entitled to be enlarged on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the entire facts and circumstances of the case and further considering the material available on record and looking to gravity of the offence and taking into account that the trial is going on, I am not inclined to release the applicant on bail. 3
7. Accordingly, the application filed under Section 483 of B.N.S.S. is rejected. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
