Matter is taken up for consideration when learned advocate representing the State respondents has filed a communication dated 2nd July, 2026 of Officer-in- Charge, Pragati Maidan Police Station, Kolkata and same is taken on record. Copy of the said communication dated 2nd July, 2026 is made over to the learned advocate representing the petitioners. 2. It is disclosed in the said communication dated 2nd July, 2026 that no cognizable offence was reported to the concerned police authority requiring registration of FIR. However, one GD entry was made. 3. If petitioners are aggrieved by in-action on the part of the concerned police authority, in that event, petitioners are required to approach jurisdictional Magistrate under Section 175(3) of BNSS for registration of FIR. 4. In this regard, reliance is placed on the judgment of the Hon’ble Supreme Court reported in 2026 SCC OnLine SC 798 (Sujal Vishwas Attavar and another vs. State of Maharashtra and others). [2] 5. Hence, writ petition is not entertained and same stands dismissed. 6. However, this order shall not preclude the petitioners to approach the jurisdictional Magistrate in pursuit of remedy. 7.
