And In the matter of : Kishor Ruidas & Ors. ……Petitioners. Mr. Apruba Kr. Datta Ms. Sreemoyee Mukherjee .....for the Petitioners. Mr. Amitabha Karmakar Mr. Rishav Kumar Singh ……for the State. Learned advocate appearing for the petitioners submit that at the inception that petitioner nos. 1, 2 and 5 has already been arrested during the pendency of the present application for anticipatory bail. So far as the other petitioners are concerned, learned advocate intends to pursue with the application and submits that a dispute between the relations over trivial issues was bolstered up and the present case has been registered. Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim under Section 164 of the Cr.P.C. Records of the case reflect that the petitioners had certain culpability, however, the principal accused has already been arrested, investigation has already been completed and charge-sheet has been submitted before the jurisdictional Court. 2 Having regard to the overall circumstances, I am of the opinion that custodial detention of the present petitioners in the present set of circumstances is unwarranted. Accordingly, the prayer for anticipatory bail of the petitioners is allowed. As such, I direct that in the event of arrest, the petitioners shall furnish bond subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since, charge-sheet has been submitted, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM (A) 990 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
