JUSTICE RAJESH KUMAR VERMA ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE) 2 20-08-2026 Heard learned counsel for the parties. 2. The present writ application has been filed in the form of a Public Interest Litigation (PIL) for the following relief(s):- “i. Issue an appropriate writ, order or direction restraining the respondents from constructing any Panchayat Bhawan or any permanent structure over the public playground situated at Mouza-Kalikapur, Thana No. 196, P.S.- Barari, District-Katihar. ii. Direct the respondents to preserve and maintain the said Government land as a public playground and community open space. iii. Direct the District Magistrate, Katihar and Circle Officer, Barari to identify any alternative suitable Government land for construction of the proposed Panchayat Bhawan. iv. Direct the respondents to conduct an enquiry regarding the nature and classification of the said land and submit a report before this Hon’ble Court. v. Pass such other order or orders as may be deemed fit and proper in the interest of justice.” 3. Upon perusal of records, it appears that the petitioner has not been able to place before this Court any Patna High Court CWJC No.12242 of 2026(2) dt.20-08-2026 3/3 cogent material in support of the allegation that the respondents are proposing to construct a Panchayat Bhawan or any other permanent structure over the alleged public playground. 4. In the absence of any substantive material in support of the allegations and in view of the vague nature of averments made in the writ application, this Court is not inclined to entertain the present PIL. 5.
