Learned AGA accepts notice for respondent Nos.1 to 5. 2. Petitioner is before this Court seeking for the following reliefs: “A. ISSUE a writ order or direction in the nature of Certiorari to quash the order of the GADIPARU passed by the 2nd respondent in case No:02/MAG/Gadiparu/DCP(E)2026 dated 22.1.2026, Vide annexure -A, B. or alternatively pass any order or orders, which this Hon'ble court may deem fit to impose.” - 3 - HC-KAR CNR: KAHC010136882026 NC: 2026:KHC:36090 WP No. 6488 of 2026 3. The grievance of the petitioner is that a show-cause notice having been issued by respondent No.2 to appear before respondent No.2 on 22.01.2026, the order was also passed on 22.01.2026 without affording an opportunity to the petitioner to file statement of objections and or to make his oral submissions. The same is borne out from the records, inasmuch as the notice has been issued calling upon the petitioner to appear on 22.01.2026 and the order has also been passed on the very same day. 4. In that view of the matter, it is clear ex facie that there is a violation of the principles of natural justice. Hence this Court passes the following order. a) Writ petition is allowed. b) Impugned order dated 22.01.2026 passed by respondent No.2 at Annexure-A, is hereby quashed. c) The petitioner is at liberty to submit his reply, which reply shall be so submitted by 11.30 a.m. on 27.07.2026. - 4 - HC-KAR CNR: KAHC010136882026 NC: 2026:KHC:36090 WP No. 6488 of 2026 d) The petitioner shall also appear before the respondent No.2 on the said date and time. e) Respondent No.2 is directed to consider the objections filed by the petitioner, afford an opportunity of hearing to the petitioner and thereafter pass necessary reasoned order.
