The civil revisional application has been preferred praying for transfer of Title Appeal No. 1 of 2026, pending before the learned 1st Additional District Judge at Uluberia to the High Court at Calcutta on the ground that the petitioner herein was in possession of a shop room under the opposite party no. 1/the Uluberia Civil Bar Association. 3. It is submitted that the said Bar Association by filing a suit against the opposite party no.2 (tenant) got an eviction decree against the petitioner (in possession) herein. 4. It is further submitted that the prayer for transfer has been made as the opposite party no. 1 is the principal defendant in the present case and the said Bar Association functions within the Court complex of the said Sub-Divisional District Court. 2 5. From the copies of the pleadings on record it appears that the opposite party no. 2 is prima facie the tenant under the opposite party no. 1. But the petitioner herein claims to have been in possession of the property, paying the tax and also has an electric connection in his name. It is thus stated that a decree of eviction has been obtained wrongfully by suppressing that the petitioner is in possession of the shop room and thus cannot be dispossessed other than by due process of law. 6. It is further submitted that considering the status of the opposite party no. 1, the petitioner herein has made this prayer for transfer as he apprehends that he may not get justice. 7. Though, no service has been effected, the Uluberia Bar Association is being represented today. 8. On hearing the learned counsels for the parties and on perusal of the materials on record, this Court finds that the petitioner herein has made out a prima facie case, in the interest of justice. 9. Accordingly, the Title Appeal No. 1 of 2026, pending before the learned 1st Additional District Judge at Uluberia, is hereby withdrawn and transferred to the Court of learned District Judge, Howrah who shall either retain the file and/or transfer the same to any other learned Additional 3 District Judges at Howrah for disposal of the appeal. 10. The transferee Court on due notice to the parties shall proceed to dispose of the appeal expeditiously, in accordance with law. 11. CO 2319 of 2026 stands disposed of. 12. Parties to act on the server copy of this order. 13. Let a copy of this order be sent to the concerned Courts for immediate compliance. (Shampa Dutt (Paul), J.)
