CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR ORAL ORDER 2 19-08-2026 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
2. The petitioner seeks regular bail in connection with Runni Saidpur P.S. Case No. 165 of 2026 lodged on 27.04.2026, for the offences punishable under Sections 103(1), 61(2), 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in brief, is that the informant was killed by the petitioner and other co-accused persons while he was in his maize field. It is further alleged that when the informant reached the place of occurrence, his agnates also threatened him in respect to partition, not being done.
4. The learned counsel for the petitioner submits that the petitioner is innocent and has nothing to do with the alleged

Learned counsel for the petitioner further submits that as per the F.I.R, the entire dispute is in respect to the partition of land and the petitioner not being the agnates, he has nothing to do with the said partition. The learned counsel also submits that the petitioner has been falsely been implicated in this case because he was present at the place of occurrence and pacifying the fight between the informant’s father and the other co- accused persons. The counsel lastly submits that is in custody since 28.04.2026.
5. The learned APP for the State vehemently opposed the prayer for bail of the petitioner.
6. Having heard the parties and taking into
consideration the fact that the underlying dispute pertains to the partition of land, wherein the petitioner is neither an agnate nor a family member and further considering that prima facie the petitioner appears to have been roped into the F.I.R solely due to his presence at the place of occurrence, coupled with the fact that only general and omnibus allegations have been levelled against the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the likewise amount each to the satisfaction of learned A.C.J.M-VI, Sitamarhi in connection

Case No. 165 of 2026, subject to the following conditions: (I) One of the bailors shall be the petitioner's own or close family member. (II) The petitioner shall co-operate in the process of trial. (III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial. (IV) The Petitioner shall not commit offence of a similar nature in future. In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
