On due consideration and for the reasons mentioned in the application I.A. No. 01/2026, the same is allowed. Delay in filing of the restoration application is hereby condoned. 3. The present MCC has been filed for restoration of Second Appeal No. 75/2026, which came to be dismissed vide order dated 28.03.2026 on account of non-removal of defects. 4. Learned counsel for the appellant submits that pursuant to the order dated 24.02.2026 granting seven days' time to remove the defects, the appellant filed the corrected cause title, requisite court fee and other necessary documents on 02.03.2026. However, Second Appeal No. 75/2026 came to be dismissed vide order dated 28.03.2026. It is submitted that the appellant was under the bona fide impression that the defects had been removed and the appeal would be listed in due course. The default, if any, was neither deliberate nor intentional. Hence, restoration of Second Appeal No. 75/2026 is prayed for in the interest of justice. 5. On due consideration and for the reasons assigned in the application, duly supported by an affidavit, this Court is satisfied that sufficient cause has been shown for restoration of Second Appeal No. 75/2026. 3 6. Accordingly, this MCC is allowed. The Registry is directed to restore Second Appeal No. 75/2026 to its original number, subject to payment of costs of Rs. 2,000/- payable to the Chhattisgarh High Court Bar Association Library Fund.
