Mr. Shataroop Purkayastha ……for the State. Learned advocate appearing for the petitioners submit that there has been alleged recovery of 1919 grams of brown sugar and although, charge-sheet has been submitted but till date charges have not been framed and the petitioners are in custody for 8 months 20 days. Learned advocate appearing for the State opposes the prayer for bail. Having considered the quantum of seizure in the present case, I am not inclined to release the petitioners on bail as rigors of Section 37 of the NDPS Act is attracted. Petitioners would renew their prayer for bail after the evidence of the seizure list witnesses are over. Accordingly, CRM (NDPS) 1313 is dismissed at this stage. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
